8.01-657 - How directed and returnable.

§ 8.01-657. How directed and returnable.

The writ shall be directed to the person in whose custody the petitioner isdetained and shall be made returnable as soon as may be before the courtordering the same, or any other of such courts.

Provided that in the event the allegations of illegality of the petitioner'sdetention present a case for the determination of unrecorded matters of factrelating to any previous judicial proceeding, such writ shall be madereturnable before the court in which such judicial proceeding occurred.
