Sec. 38a-540. (Formerly Sec. 38-262g). Duplication of coverage under group health insurance policies.

Sec. 38a-540. (Formerly Sec. 38-262g). Duplication of coverage under group health insurance policies. In any case in which a husband and wife are employed by the same employer and, by reason of their employment, are both eligible for coverage under the terms of any health insurance policy issued under a group plan and by an insurance company, hospital or medical service corporation, health care center or fraternal benefit society, such husband and wife shall not be required as a condition of their employment or as a condition of coverage under such plan, to pay any premium which does not result in greater coverage than would be provided if only one of them were eligible to participate in such group plan.

      (P.A. 79-283, S. 1; P.A. 80-248, S. 1; P.A. 90-243, S. 121.)

History: P.A. 80-248 referred to eligibility for coverage under terms of any "health insurance policy ... issued under a group plan and by a carrier ..." rather than coverage under terms of any "accident, health or accident and health insurance policy issued under a group plan"; P.A. 90-243 made technical changes for statutory consistency; Sec. 38-262g transferred to Sec. 38a-540 in 1991.
