Section 21-316 - Hearings.

§ 21-316. Hearings.
 

(a)  Right to hearing.- Except as otherwise provided in Title 10, Subtitles 2 and 3 of the State Government Article, before the Department takes any final action under § 21-311 or § 21-315 of this subtitle, the Secretary shall give the person against whom the action is contemplated an opportunity for a hearing before the Department. 

(b)  Application of contested case provisions.- The Department shall give notice and hold the hearing in accordance with Title 10, Subtitle 2 of the State Government Article. 

(c)  Notice.- The Department shall send the hearing notice to the applicant or licensee by certified mail, return receipt requested, bearing a postmark from the United States Postal Service. 

(d)  Decision and notification of parties within 30 days.- Within 30 days after the hearing required under this section, the Department shall decide the issue and immediately notify the parties to the hearing.
