Calculation of reimbursement allowance amount--notification ofMedicaid managed care organizations--offset permitted, when.

208.433. 1. The director of the department of social services shallmake a determination as to the amount of Medicaid managed careorganization's reimbursement allowance due from each Medicaid managed careorganization.

2. The director of the department of social services shall notifyeach Medicaid managed care organization of the annual amount of itsreimbursement allowance. Such amount may be paid in monthly incrementsover the balance of the reimbursement allowance period.

3. The department of social services may offset the managed careorganization reimbursement allowance owed by the Medicaid managed careorganization against any payment due that managed care organization only ifthe managed care organization requests such an offset. The amounts to beoffset shall result, so far as practicable, in withholding from the managedcare organization an amount substantially equivalent to the reimbursementallowance owed by the managed care organization. The office ofadministration and state treasurer may make any fund transfers necessary toexecute the offset.
