265.130. All apples which are sold, offered or exposed forsale in Missouri shall be plainly and conspicuously marked with asign bearing the name of the variety, the minimum size and thegrade, and each package of apples which is sold, offered,exposed, or packaged for sale by a grower or packer shall, inaddition, be plainly and conspicuously marked with the name andaddress of the grower or packer. The director shall exempt fromthe provisions of this section apples which are marked with, andmeet the requirements of, grades of the United States Departmentof Agriculture or well established grades promulgated by otherstates; provided, that such apples are otherwise marked inaccordance with the provisions of this section. Any personviolating any of the provisions of this section shall be deemedguilty of a misdemeanor. In addition, any apples found to beoffered or exposed for sale in violation of this section may beordered temporarily withdrawn from sale by the director, pendingeither informal adjustment according to law between the directoror his duly authorized representative, and the person in chargeof the apples in question, or the filing of a formal complaint,without undue delay, with the attorney general or prosecutingattorney.
