Extension of boundaries if petition does not include all requiredsignatures, effect--election, ballot form.

321.301. 1. If the petition to add any territory or tractof land to the district contained fewer than all of thesignatures required pursuant to subdivision (2) of subsection 2of section 321.300, the decree of extension of boundaries shallnot become final and conclusive until it has been submitted to anelection of the voters residing within the boundaries describedin such decree and until it has been assented to by a majorityvote of the voters in the newly included area voting on thequestion. The decree shall also provide for the holding of theelection to vote on the proposition of extending the boundariesof the district, and shall fix the date for holding the election.

2. The question shall be submitted in substantially thefollowing form:

Shall the boundaries of the . . . . . . . . . . . . FireProtection District be extended to include the followingdescribed property? (Describe property.)

3. If a majority of the voters voting on the propositionvote in favor of the extension of the boundaries of the district,then the court shall enter its further order declaring the decreeof extension of the boundaries to be final and conclusive. Inthe event, however, that the court finds that a majority of thevoters voting thereon voted against the proposition to extend theboundaries of the district, then the court shall enter itsfurther order declaring the decree of extension of boundaries tobe void and of no effect.
