Property in city of 40,000 inhabitants not wholly within district, tobe excluded.

321.320. If any property, located within the boundaries of afire protection district, is included within a city having apopulation of forty thousand inhabitants or more, which city isnot wholly within the fire protection district, and which citymaintains a city fire department, the property is excluded fromthe fire protection district.
