§ 14‑208.40C. Requirements of enrollment.

(a)        Any offenderrequired to enroll in satellite‑based monitoring pursuant to G.S. 14‑208.40Aor G.S. 14‑208.40B who receives an active sentence shall be enrolled andreceive the appropriate equipment immediately upon the offender's release fromthe Division of Prisons.

(b)        Any offenderrequired to enroll in satellite‑based monitoring pursuant to G.S. 14‑208.40Aor G.S. 14‑208.40B who receives an intermediate punishment shall,immediately upon sentencing, report to the Division of Community Correctionsfor enrollment in the satellite‑based monitoring program, and, ifnecessary, shall return at any time designated by that Division to receive theappropriate equipment. If the intermediate sentence includes a required periodof imprisonment, the offender shall not be required to be enrolled in thesatellite‑based monitoring program during the period of imprisonment.

(c)        Any offenderrequired to enroll in satellite‑based monitoring pursuant to G.S. 14‑208.40Aor G.S. 14‑208.40B who receives a community punishment shall, immediatelyupon sentencing, report to the Division of Community Corrections for enrollmentin the satellite‑based monitoring program, and, if necessary, shallreturn at any time designated by that Division to receive the appropriateequipment.
