§ 14-34.4. Adulterated or misbranded food, drugs, or cosmetics; intent to cause serious injury or death; intent to extort.

§14‑34.4.  Adulterated or misbranded food, drugs, or cosmetics; intent tocause serious injury or death; intent to extort.

(a)        Any person who withthe intent to cause serious injury or death manufactures, sells, delivers,offers, or holds for sale, any food, drug, or cosmetic that is adulterated ormisbranded, or adulterates or misbrands any food, drug, or cosmetic, inviolation of G.S. 106‑122, is guilty of a Class C felony.

(b)        Any person who withthe intent to wrongfully obtain, directly or indirectly, anything of value orany acquittance, advantage, or immunity communicates to another that he hasviolated, or intends to violate, subsection (a) of this section, is guilty of aClass C felony. (1987, c. 313.)
