§ 14-437. Violation of Article; penalties.

§ 14‑437.  Violation ofArticle; penalties.

(a)        Every individualact in contravention of the provisions of this Article shall constitute a Class1 misdemeanor, except that the offense is a Class I felony with a maximum fineof one hundred fifty thousand dollars ($150,000) if (i) the offense involves atleast 100 unauthorized articles during any 180‑day period, or (ii) is athird or subsequent conviction for an offense that involves at least 26unauthorized articles during any 180‑day period.

(b)        If a person isconvicted of any violation under this Article, the court, in its judgment ofconviction, shall order the forfeiture and destruction or other disposition of:

(1)        All infringingarticles; and

(2)        All implements,devices and equipment used or intended to be used in the manufacture of theinfringing articles. (1973, c. 1279, s. 1; 1989, c. 589, s. 1; 1993, c. 539, ss. 291, 1246;1994, Ex. Sess., c. 24, s. 14(c); 2003‑159, s. 5.)
