§ 161‑4.2. Liability insurance for register of deeds.

To the same extent that the county provides liability insurance toother county officers or employees, pursuant to G.S. 153A‑97 and 160A‑167,or 58‑32‑10, or Article 23 of Chapter 58 of the General Statutes,the county shall provide insurance to the register of deeds.  If the countydoes not provide insurance to any officers or employees, then the county shallnotify the register of deeds, in writing, prior to the first Monday in Decemberof each year, of its intent not to provide insurance coverage to the registerof deeds.  This required notification shall be in the form of a letter signedby the chairman of the board of county commissioners, attested by the clerk ofthe board of county commissioners.  If the county fails to provide the requirednotice, then the county shall be liable for damages that would have been paidhad the county purchased the insurance pursuant to the General Statutessections cited above.
