§ 27-6-30 Appeals from action of ratingorganization on changes in filings. (a) Any member of or subscriber to a rating organization may appeal to thecommissioner from any action or decision of the rating organization inapproving or rejecting any proposed change in or addition to the filings of therating organization, and the commissioner shall, after a hearing held upon notless than ten (10) days written notice to the appellant and to the ratingorganization, issue an order approving the action or decision of the ratingorganization or directing it to give further consideration to the proposal andto take action or make a decision upon it within thirty (30) days, or if theappeal is from the action or decision of the rating organization in rejecting aproposed addition to its filings, the commissioner may, in the event he or shefinds that the action or decision was unreasonable, issue an order directingthe rating organization to make an addition to its filings, on behalf of itsmembers and subscribers, in a manner consistent with his or her findings,within a reasonable time after the issuance of the order; provided, if theappeal is from the action of the rating organization with regard to a rate on aproposed change in or addition to its filings relating to the character andextent of coverage, the commissioner shall approve the rate applied by therating organization or the rate suggested by the appellant if either rate is inaccordance with this chapter.
(b) The failure of a rating organization to take action ormake a decision within thirty (30) days after submission to it of a proposalunder this section shall constitute a rejection of that proposal within themeaning of this section.
